Terms of Service

These Terms of Service ("Terms") govern your use of the Family Stori platform operated by Berry App Labs (berryapplabs.com). By using Family Stori, you agree to these Terms.

1. The Service

Family Stori is a question-and-answer storytelling platform purchased as a gift. A gift-giver purchases a subscription for a storyteller, who receives weekly questions and records their life stories through text, photos, and video. Family circle members can read answers, take quizzes, and receive weekly digest emails.

2. Accounts

Accounts are created when a storyteller redeems a gift code. Each gift code activates one storyteller account. The gift-giver and circle members do not need separate accounts to participate. You are responsible for keeping your login credentials secure.

3. Subscriptions and Refunds

• Subscriptions are billed annually.
• Refund requests made within 30 days of purchase will be honoured in full.
• After 30 days, subscriptions are non-refundable.
• To request a refund, email hello@familystori.com with your gift code or account email.

4. Content Ownership

You own your answers, photos, and videos. By using Family Stori, you grant us a limited licence to:

• Store your content on our servers
• Display your content to family circle members you have invited
• Include your content in weekly digest emails sent to your circle
• Generate quizzes from your answers for your family circle
• Process your content through AI services for translation and question personalisation

This licence ends when you delete your account. Upon deletion, all your content is permanently removed from our systems.

5. Acceptable Use

Family Stori is a platform for sharing family stories. You agree not to use the platform to:

• Post hate speech, harassment, threats, or discriminatory content
• Share illegal content or content that violates the rights of others
• Spam, advertise, or distribute unsolicited messages
• Upload malware or attempt to compromise the platform's security
• Impersonate other users or misrepresent your identity

We reserve the right to remove content that violates these guidelines and to suspend or terminate accounts of repeat offenders.

6. Content Moderation

We may review content that has been reported by other users. If you encounter inappropriate content within your family circle, you can report it through the app. We will review reported content and take appropriate action, which may include content removal or account suspension. Repeated violations may result in permanent account termination.

7. Printed Books

Printed story books are an optional add-on service. Content is printed as provided by the storyteller. We do not edit, censor, or alter the content of printed books. You are responsible for ensuring the content you choose to print is appropriate.

8. Data Export

You can export all your data at any time through the app. Exported data includes your profile information, all text answers, photos, videos, and quiz data. We believe your stories belong to you and you should always have access to them.

9. Account Termination

By you: You can delete your account at any time through the app or by emailing hello@familystori.com. Account deletion is permanent and removes all your data from our systems.

By us: We may terminate accounts that violate these Terms, engage in abusive behaviour, or are used for illegal purposes. We will make reasonable efforts to notify you before termination unless immediate action is required.

10. Limitation of Liability

Family Stori is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee uninterrupted service, error-free operation, or that data loss will never occur.

To the maximum extent permitted by law, Berry App Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising from your use of the service.

Our total liability for any claims arising from or related to the service shall not exceed the amount you paid for your subscription in the 12 months preceding the claim.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the service shall be resolved in the courts of the State of Texas.

12. Changes to These Terms

We may update these Terms from time to time. For material changes, we will provide at least 30 days' notice by email before the new terms take effect. Your continued use of the service after the effective date of revised Terms constitutes your acceptance of those changes.
